Jewish schools react to proposed law

PROPOSED legislation that would prohibit religious schools in Victoria from firing or refusing to hire teachers based on gender and sexual identity has been met with a mixed reaction from within the Jewish community.

The Andrews’ government bill, introduced to Parliament in October, seeks to protect LGBTQI+ Victorians’ right to work in faith-based schools.

Last month, a group of religious leaders from varying faiths sent an open letter to Victoria’s Attorney-General, Jaclyn Symes, opposing the legislation, stating that it “unfairly targets religious bodies and educational institutes”.

Among the signatories was Rabbi Shimon Cowen from the Institute for Judaism and Civilisation. He told The AJN that the legislation is “an incredible invasion of religious life,” accusing the state government of attempting to “edit Judaism”.

He called politicians who support it “hypocrites,” noting that parliamentarians are allowed to discriminate based on political views and activity when it comes to the staffing of their office.

But most Jewish schools were generally more supportive.

Bialik College principal Jeremy Stowe-Lindner, who proudly recalled that his was the first school in Australia to sign up to the Marriage Equality campaign, told The AJN, “We are all created equally and I strongly encourage the law to support this, and prevent discrimination.”

Without it, he reflected, “Future generations would look at us with the same incredulity that we hold when we consider those who opposed the emancipation of slaves, universal suffrage or civil rights.”

The King David School principal Marc Light concurred, stating, “We oppose any legislation that discriminates against people based on their gender or sexual identity.”

He added, “It is important that LGBTQI+ students get the message that they are not alienated, excluded or rejected on the basis of their identity.”

Helen Greenberg, principal at Sholem Aleichem College, said, “We strongly embrace any changes that allow Victorians to continue to be free to live and work free from discrimination.”

Leibler Yavneh College principal Cherylyn Skewes agreed, noting, “Our view is clear. No staff member should be subject to discrimination or termination on the basis of their sexual identity.”

Noting that the legalisation would remove the right of schools to sack a staff member because of their sexuality, Mount Scopus Memorial College principal Rabbi James Kennard said, “Since that would never happen at Mount Scopus, the bill is not especially relevant to our school.”

Rabbi Elisha Greenbaum of Yeshivah–Beth Rivkah Colleges had some reservations about the bill. He said that “while people’s private lives are not a factor in their hiring, a school was not generally an appropriate place for staff to discuss or flaunt their sexual behaviour, whether heterosexual or homosexual.”

He also pointed out that while “the aims of the legislation to prevent discrimination were laudable, there was some concern that activists could potentially misuse the legislation by challenging the curriculum, or even the teaching of certain sections of the Torah”.

But not everyone is on board. A member of another Orthodox school community told The AJN that if the bill were to pass, it “could be a problem” because they would not have the “flexibility they would need regarding LGBTQI+ staff teaching their students”.

On a federal level, after a 2018 pledge by Prime Minister Scott Morrison, the PM recently introduced his Religious Discrimination Bill to the floor. The legislation – if passed – will offer protection for faith-based schools, institutions, hospitals and aged-care facilities that wish to prioritise applicants of their faith. While it will be several months before the Senate votes on the bill, the legislation could override the Victorian Government’s anti-discrimination bill.

Fighting prejudice against AIDS sufferers

AS A YOUNG Orthodox Jew working in a voluntary capacity for the Victorian AIDS Council, Tammi Faraday has often been forced to defend her job.

For the 20-year-old Leibler-Yavneh graduate, however, there is no conflict between her religion and her work.

“I have been asked how, as a religious Jew, I can work for an organisation that is condoning homosexuality,” she said, in an interview with the Australian Jewish News. “First of all, my position on homosexuality is absolutely inconsequential to the cause; Regardless of what I feel, it is not for me to judge.

“We talk of God and we talk of mercy and compassion and all these other things that people very easily forget. Ritualism is very important, but I think the essence of religion often gets lost.”

Ms Faraday said that homosexuality was “problematic” within the Torah. But by the same token, she added, the saving of a life is a fundamental precept in the Jewish religion.

“We should perpetuate that by helping people and by educating people. And it is not just gays who are affected (by AIDS).

“I think there is a syndrome in the Jewish community of being very judgmental. People should be embraced. Thank God, the incidence of AIDS is not huge within the Jewish community, but I don’t think that anybody has the right to disenfranchise a person or to make a person feel remote or ostracised. It is an issue that has to be dealt with.”’

Ms Faraday, who is currently studying law/arts at Monash University, has also been asked why she has not channelled her energies into Jewish causes. It is a question to which she has taken umbrage.

“To me, AIDS is a human cause,” she said. “It is a Jewish cause as much as any other cause. I am a very proud Jew who wears Judaism on my sleeve. But we are human and we are not immune to this disease.”

Ms Faraday first developed an interest in AIDS at the age of 14 when she read a book on a haemophiliac who had contracted the HIV infection through a blood transfusion. After spending eight months studying at the Hebrew University in Israel, she approached the Victorian AIDS Council in April this year.

Ms Faraday is now public relations officer for the Council’s Red Ribbon Project. Red ribbons, the international symbol for AIDS awareness, will be sold by shops, businesses and street sellers for World AIDS Day on December 1. All proceeds from the red ribbons go towards the support of men, women and children living with HIV/AIDS.

“I was very nervous to come back to Australia after living in Israel,” Ms Faraday said. “I had been very fulfilled there and all my senses had been on overload every minute of the day.

“When I came back, I wanted to throw myself into an organisation where I felt I could provide some expertise and do something positive to help others.”

Ms Faraday also believed there were many misconceptions about AIDS with many Australians still referring to it as the ‘gay plague’.

“That is not the case,” she said. “It’s a universal disease and it doesn’t discriminate. I felt that as someone who was Jewish and a woman and a minority in this organisation, I would be able to help universalise the issue.

“Now the figures show that AIDS is decreasing slowly in the gay population, but increasing substantially in the heterosexual population… Twenty million people have been infected with the (HIV) virus thus far around the world. It is the highest killer of 22 to 44-year old Americans. It is an epidemic we are facing.”

Ms Faraday conceded she initially felt like the “odd one out” at the Council, but quickly found her niche.

“The environment here is so warm, friendly, loving and supportive. It’s a wonderful environment to work in.

“I wanted to ensure I confronted the disease head-on and be knowledgeable about it so I was not prejudiced in any way, shape or form. Knowledge is the key.”

ECAJ ‘cautiously welcomes’ findings

THE Executive Council of Australian Jewry (ECAJ) has “cautiously welcomed” the long-awaited release of the Religious Freedom Review and the federal government’s response.

The government has endorsed 15 of the 20 recommendations in the report, which was handed down in May but only released last week.

Prime Minister Scott Morrison said the government plans to introduce a Religious Discrimination Act, employ a Freedom of Religion Commissioner at the Human Rights Commission and look to introduce a range of other amendments.

The issue of whether religious schools should be allowed to discriminate based on LGBTI+ status has been deferred for the time being.

“Discrimination on the basis of a person’s identity – including their religious identity – is unacceptable … we [also] respect the right of religious institutions to maintain their distinctive religious ethos. Our laws should reflect these values,” Morrison and Attorney-General Christian Porter said last week.

“Our commitment to striking an appropriate balance is clear. We are committed to finding a way forward that cuts through the political debates about whether some rights are more important than others.”

ECAJ co-CEO Peter Wertheim said that although the roof body believed religious freedom in Australia is not under threat, “as both an ethnic and a faith community we support the government’s intention ‘to further protect, and better promote and balance, the right to freedom of religion under Australian law and in the public sphere’.”

He said there “should be little controversy” about the endorsed recommendations, but did say the introduction of a Religious Discrimination Act will be more contentious.

“On the one hand the legislation will prohibit discrimination on the basis of a person’s religious belief or activity … on the other hand there will be similar exemptions to those in other anti-discrimination legislation,” he said.

“In practice, however, some difficult situations may arise in which one or the other principle will have to give way, and where no broad social consensus exists as to which principle ought to prevail.”

Wertheim added the creation of the Freedom of Religion Commissioner role was “good sense”.

Australia/Israel & Jewish Affairs Council director of community affairs Jeremy Jones said the government would have a “difficult task trying to get the correct balance between protecting the right of all Australians to enjoy religious freedom while also trying to ensure that we can have full and robust discussion on matters of concern”.

Zoe Goodhardt, Liebler Yavneh College, religious freedom and equality

One parent at Leibler Yavneh College is reported to not value “freedom and equality” for her children despite the school stating it won’t discriminate against LGBTIQ students and staff.

When it comes to freedom and equality, she says there are plenty of other schools for parents to enrol their children, but choosing a school for Ezra, Rami and ­Jasmine was about choosing a community.

As such, we ask that the Senate Inquiry ensures that no student or staff member suffers any form of discrimination including those relating to sexual orientation and gender.

It’s unclear exactly what Zoe Goodhardt had in mind when she was responding to a question from The Australian on “freedom and equality”, but what is clear is the position Leibler Yavneh College has made on not discriminating against LGBTIQ students and staff.

It’s disappointing comment was not sought by The Australian from the school’s principal, as this would have offered the necessary degree of balance and perspective that is typically absent from this publication’s content.


Keeping religion alive lies at heart of family’s values

Sending her three children to Leibler Yavneh College at Elsternwick, in Melbourne’s southeast, is a form of “life insurance” for Zoe Goodhardt.

But this is an insurance policy like no other. It is the guarantee, Ms Goodhardt says, that her family’s Jewish faith and way of life can continue untrammelled.

So it is no surprise as rising secularism clashes with the beliefs and values of traditional faiths that Ms Goodhardt, 32, has rushed to support Scott Morrison’s pledge to protect religious freedom.

The Prime Minister’s commitment to overhaul federal discrimination laws, revealed in The Australian yesterday, is intended to introduce new provisions prohibiting discrimination against the right of individuals to practise their religions.

“I think it’s our right, and the right of the school, to cultivate a community at the school in line with their ethos and values,” Ms Goodhardt says.

When it comes to freedom and equality, she says there are plenty of other schools for parents to enrol their children, but choosing a school for Ezra, Rami and ­Jasmine was about choosing a community.

At Yavneh College, that community is based around the modern orthodox school’s mission to adhere to Jewish law (Halacha), ethical behaviour (Derech Eretz) and Zionist ideals.

Mr Morrison’s pledge on religious freedom will allow Yavneh to keep its strict admission policy permitting Orthodox Jews only.

“I know the kids could get a great education at a public school, but I want them to grow up in a community with our values,” Ms Goodhardt says.

“It’s problematic to think that the school I and my family have grown up in wouldn’t have the right to continue with their ­culture.”

Ms Goodhardt, a marketing manager, lives with her husband, Dan, and their children in Caulfield North, a suburb in the heart of Melbourne’s Jewish community, the nation’s largest.

Both also attended Yavneh.

Zoe Goodhardt’s parents were the children of Holocaust survivors, originally from Lodz, Poland, who arrived in Australia after the war looking for a safe Jewish community.

Mr Goodhardt, a counter-­terrorism analyst, arrived from England as a boy with his parents, whose similar quest was “for a free Jewish community”.

The family, says Ms Goodhardt, feels safe but with much thanks to the Jewish community in Melbourne that has been able to grow. Daughter Ezra, 6, has just finished Grade 1 at Yavneh while Rami, 4, has completed senior kinder at the school; Jasmine, 1, will start at the Yavneh creche next year.

In its mission statement, ­Yavneh says the school strives to develop resilient, independent learners equipped to “participate effectively as Jews in the outside world”. The school embraces Australian heritage as well, encouraging students to take pride in it and contribute to the nation’s future.
